Unlawful discrimination

PROTECTED CHARACTERISTICS

Work can be stressful enough without being treated unfairly. Workplace discrimination is unfair and illegal. Being treated less favourably or being discriminated against for the following reasons is protected against under the law:

  • Race

  • Pregnancy or requesting parenting leave

  • Age

  • Sexual orientation

  • Gender re-assignment surgery

  • Disability (or caring for a disabled person)

  • Getting married or entering into a civil partnership

 

If this occurs, then there are laws (such as the disability discrimination law) so your employer can be challenged as to why this has happened.

Making a claim

An employer can also be guilty of positive discrimination. This occurs when someone is selected for employment or promotion based on a protected characteristic rather than their suitability for the role. Although it is often used to try and promote equality, it can be seen as reverse discrimination as it favours one group over another. Positive discrimination is different to positive action, where an organisation may include programs to help underrepresented groups.
